TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of the furnishing services provided by Design By Stay. By engaging our services, you agree to these Terms. If you do not agree, please refrain from using our services.
1. General Information
Design By Stay specializes in furnishing single units with style and functionality for rentals or personal spaces. These Terms apply to all clients who engage in our furnishing services.
2. Eligibility
By using our services, you confirm that you are at least 18 years old and legally capable of entering into a contract.
3. Furnishing Services
When engaging our services, you agree to:
Provide accurate and complete information regarding your property and furnishing needs.Approve design plans and budgets before work begins.Allow us reasonable access to the property for furnishing, installation, and delivery.
4. Payments & Fees
A 5% initial payment is required before we proceed with purchasing furniture and materials. This payment is non-refundable.Additional payments will be outlined in the service agreement and must be made according to the agreed-upon schedule.Failure to make payments may result in project delays or cancellation.
5. Cancellation Policy
a. Cancellation
Upon signing the contract, a 5% initial payment is required. Cancellations may only be made prior to the contract being signed and the initial payment being submitted. Once the initial payment has been processed, cancellation is no longer permitted.
b. Modifications & Rescheduling
If you wish to modify or reschedule your furnishing project, we will do our best to accommodate changes. However, additional costs may apply depending on supplier policies and project adjustments.
c. Rush Orders & Last-Minute Changes
If you request a rush order or make last-minute changes to the furnishing plan, additional costs may apply.
6. Client Responsibilities
As a client, you agree to:
Provide access to the property for deliveries, setup, and installation.
Communicate any special requirements or restrictions in advance.
Ensure the property is ready for furnishing (e.g., clean, free of obstructions).
7. Liability
Client Liability: You are responsible for any damages caused to the furnishings after delivery and installation.
Company Liability: We ensure that all furniture is delivered in good condition and installed correctly. However, we are not responsible for damages caused by improper use or third-party negligence.
Limitation of Liability: Design By Stay shall not be liable for indirect, incidental, or consequential damages resulting from furnishing services.
8. Force Majeure
We shall not be held responsible for delays or failures due to events beyond our control, including but not limited to natural disasters, supplier shortages, labor strikes, or governmental actions.
9. Changes to Terms and Conditions
We reserve the right to update or modify these Terms at any time. Any changes will be posted with an updated effective date.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California.
